Environment Court Prescribed Forms
These forms are prescribed by the Resource Management (Forms, Fees, and Procedure) Regulations 2003.  The fees were amended by the Resource Management (Forms, Fees, and Procedure) Amendment Regulations 2009 and came into effect on 7 May 2009.

Environment Court Filing Fees
The filing fee for each appeal/application type is listed with the appropriate section/form below. All fees are GST inclusive. If you pay your fee in cash at an Environment Court office, we will round the fee down to the nearest ten cents.

Waiver, Reduction and Postponement of Environment Court Fees

The Registrar (and Deputy Registrars) have the power to waive, reduce and/or postpone some Environment Court fees, upon application, in limited circumstances. The fees that might be waived, refunded or postponed are those prescribed in section 281A of the Resource Management Act 1991.

These fees can only be waived or reduced or postponed if either: you are unable to pay the fee; or the proceedings concern a matter of public interest and are unlikely to proceed if the fee was required.

Applicants for waiver should complete a Request for Waiver, Reduction or Postponement of Fees and forward the completed form to the appropriate registry office who will contact you once a decision has been made by the Registrar. (Word version available upon request from Registry).

s.274 Interested Party Notices and the Resource Management (Simplifying and Streamlining) Amendment Act 2009

The amendment came into effect 1 October 2009, with it came a substantial change to the time period for lodging an interested party notice pursuant to s.274 of the Resource Management Act.

Where applications at Council level have been initiated prior to 1 October 2009, all those wishing to become a party have 30 working days from the date of lodgement of the appeal with the Environment Court in which to lodge their notice of interest.

Where applications at Council level have been initiated post 1 October 2009, all those wishing to become a party have 15 working days from the end of the appeal period in which to lodge their notice of interest.
