There are three approaches that might be taken in response to the problems with criminal procedure. The recommended approach (Option 1) is to implement an integrated package of comprehensive reform, using a range of legislative and non-regulatory instruments. However, more limited or ‘targeted’ legislative change and non-regulatory improvements might be contemplated; and there remains the option to maintain the status quo.
