TribunalsOther Statutory Bodies Supported or Functions Performed by the Tribunals UnitAbortion Supervisory CommitteeLegislative Basis:The Abortion Supervisory Committee is established under section 10 of the Contraception, Abortion and Sterilisation Act 1977. Structure:The committee consists of three members; two of whom are to be registered medical practitioners. One member is appointed as the committee’s Chairperson. Functions:The Committee has the responsibility for keeping under review all the provisions of the abortion law in New Zealand, and the operation and effect of those provisions in practice. This includes licensing institutions for the performance of abortions and appointment of certifying consultants to consider cases. Criminal Justice Reimbursement SchemeThe Tribunals Unit administers the Criminal Justice Reimbursement Scheme. Applications are considered for compensation for any material loss caused by victimisation suffered as a result of assisting in the administration of justice. This scheme is not established by legislation and therefore has no statutory basis. It has been established by Ministerial directive. Lay Members (NZ Law Practitioners Disciplinary Tribunal)Legislative Basis:Law Practitioners Act 1982 Lay members sit as members of the District and New Zealand Law Practitioners Disciplinary Tribunals in accordance with s108 of the Law Practitioners Act 1982. The Tribunals Unit acts as effectively the paying office for sitting fees for these members. Lay ObserversLegislative Basis:Section 96 of the Law Practitioners Act 1982 Structure:There are currently 5 Lay Observers based nationally with responsibilities across District Law Societies. Lay Observers cannot be practising Barristers and Solicitors. Functions:The principal function of Lay Observers are to examine any written allegation made by or on behalf of a member of the public concerning any District Law Society’s treatment of a complaint about the conduct of a practitioner, or an employee of a practitioner.
