Police v V (30 August 1991) YC, Auckland, Brown DCJName: Police v V Summary: V (15) had long history of offending, many FGCs, reports and placements. Unusual to transfer 15 year old to District Court but transfer effected after s284 factors considered. Relevant here was: persistent offending, unrepentant and manipulative attitude, ineffectual family response; also principles in s208(g) regarding victims interests considered - particularly relevant where lengthy period of offending involved. Non-custodial alternatives inadequate. Decision: Transfer to District Court. Remanded pursuant to s238(1)(e). |
