Police v G (10 February 1999) YC, Hamilton, Brown DCJName: Police v G Summary: Gs fingerprints taken in connection with a burglary; Gs counsel argued that the Police Act 1958, s57 did not authorise that taking of fingerprints as "person" in s57(1) does not include children and young people. Further, that s57(3) is evidence that no attention has been paid to the provisions of the CYPFA in the application of that subsection; use of word "acquitted". Held: "person" in s57(1) includes children and young people; as to s57(3), when a charge against a young person is dismissed in the YC, the generic term for this is acquittal; if someone is acquitted in the YC their fingerprints are to be destroyed. Decision: Argument to exclude Gs fingerprints dismissed. |
