Mr Chittock was rendered a tetraplegic as a result of injuries he received in a motor vehicle accident on 30 November 1983 and has cover under the Accident Compensation Act 1982. The appeal concerns ACC’s decision of 9 May 2007 by which it accepted that Mr Chittock remained entitled to receive entitlements under s 80(3) of the 1982 Act, but declined his request for backdated and ongoing payments under s 80(3), to be paid from 11 September 1995. The appeal under ACA 8/13 concerns an appeal against the costs awarded by the Review Officer in respect of three applications for review of decisions made by ACC in 1988, in the course of considering Mr Smith’s request for a reassessment of his lump sum compensation award for permanent disability, reinstatement of his earnings related compensation that had ceased in 1981, and retraining assistance to become a diesel mechanic.
