The Ministry of Justice provides a range of advice to our Ministers on topics relevant to our work programme, Ministerial priorities and around ongoing legislation.

This page provides a list of advice that has been sent. Items below are listed from newest to oldest.  Please note that this is not a complete list, items may have been withheld, the most common grounds for withholding this information are under the following sections of the Official Information Act.

  • Section 9(2)(f)(iv) - maintain the constitutional conventions for the time being which protect the confidentiality of advice tendered by Ministers of the Crown and officials.
  • Section 9(2)(g)(i) - maintain the effective conduct of public affairs through the free and frank expression of opinions by or between or to Ministers of the Crown or members of an organisation or officers and employees of any public service agency or organisation in the course of their duty.
  • Section 9(2)(h) - maintain legal professional privilege.

You have a right to request a copy of any document listed under the Official Information Act.  Publication of any title does not preclude the item being withheld either in part or in full should it be requested.  

There may be some instances where items are listed twice, once to each Minister. This indicates that it was provided to both Ministers for either action or noting
