What is NZLII?

The New Zealand Legal Information Institute (NZLII) is a joint project of the University of Otago Faculty of Law, University of Canterbury and the Australasian Legal Information Institute (AustLII) with the assistance of the Law School, Victoria University of Wellington.

Right of Appeal

If you are dissatisfied with a decision given by the Motor Vehicle Disputes Tribunal you may appeal to the District Court.  You have ten (10) working days from the date of the decision to lodge a Notice of Appeal.

An appeal against an Order that is for less than $12,500 may be brought on the grounds that the proceedings were conducted in a manner that was unfair to the appellant and prejudicially affected the result of the proceedings.

An appeal against an Order that exceeds $12,500 can be brought on the grounds that the Disputes Tribunal decision was wrong in fact or law, or in both fact and law OR that the proceedings were conducted in a manner that was unfair to the appellant and prejudicially affected the result of the proceedings.

If an appeal is filed in the District Court please ensure that a copy of the appeal is forwarded to the other party and to the office of the Motor Vehicle Disputes Tribunal.

Enforcement

If you are the party who has been ordered to pay a sum of money, you should contact the other party/parties to discuss arrangements to comply with the order. 

If you are due payment and the order of the Tribunal has not been complied with you can apply for an order for it to be enforced.  You must wait until the appeal period of ten (10) working days has expired.

To apply for an enforcement order the following procedure should be followed:

Ban from trading as a Motor Vehicle Trader

A person can be banned from trading if that person has more than once, within ten consecutive years, failed to comply with an order of the Tribunal.  You can make a complaint regarding a possible ban from trading by contacting the Motor Vehicle Traders Registrar, Ministry of Business, Innovation & Employment, by email on registrar@mvtr.govt.nz
