Fees and charges for civil enforcement

Overview

When you file an application for civil enforcement you must also pay the fee. There are different fees for different services.

How to pay fees for enforcement action

Any party (creditor or debtor) applying for civil enforcement action must pay the fees at the time of applying.

If the judgment order has more than one debtor, the creditor must file an application form and pay fees for each debtor individually.

  1. You can pay the fee in person at the district court. You do not have to be filing your application at the same time, but you can. You can pay with cash, eftpos or a debit or credit card. You will get a receipt confirming your payment.

  2. You can pay the fee through the online File and Pay service. You do not have to file your application at the same time, but you can. You can pay with debit or credit card only. You will get an email receipt confirming your payment.

If you are only paying the fee through File and Pay (and not filing your application at the same time), you need to print out your receipt and include it when you file your application.

You will find fees under the Civil District Court “Court type” and the Civil Enforcement “Case type”.

File and Pay(external link) is on the Courts of New Zealand website.

  3. If you are posting or couriering your application, you need to include proof you have paid the fee, such as a receipt. You can get a receipt when you pay in person at the district court or through File and Pay.
