What happens next

When your application letter containing your complaint or appeal is received, the tribunal considers it. 

People involved in appeals (the parties) may be required to file additional information

What decisions the tribunal could make

If a complaint or appeal is upheld against an immigration adviser, the Immigration Advisers Complaints & Disciplinary Tribunal can:

  • caution or censure the adviser
  • require the adviser to undertake training
  • suspend their licence
  • cancel their licence
  • make an order to prevent the adviser from reapplying for a licence for up to 2 years or until certain conditions are met
  • pay a penalty up to $10,000
  • pay costs
  • repay fees or expenses to the person who complained or other person
  • pay compensation to the person who complained or other person.

What decisions the tribunal could make

After considering an appeal, the Immigration Advisers Complaints & Disciplinary Tribunal can:

  • reject the appeal
  • determine that the decision of the Registrar was incorrect but nevertheless reject the complaint upon another ground
  • determine that it should hear the complaint, and direct the Registrar to prepare the complaint for filing with the tribunal
  • determine that the Registrar should ask the person who complained to consider whether or not the matter could be best settled using the immigration adviser's own complaints procedure.
